1. Agreement and Acceptance
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Customer", "you") and KrishnaAman Ventures ("we", "us", "our") governing your access to and use of WA Bulk Sender, including the website at https://kritap.krishnaaman.in, web application, dashboard, APIs, and related services (collectively, the "Service").
By creating an account, clicking "I agree", or using the Service, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, you must not use the Service.
If you use the Service on behalf of a company or organisation, you represent that you have authority to bind that entity to these Terms.
2. Eligibility
- You must be at least 18 years old and capable of entering a binding contract under Indian law.
- You must use the Service for legitimate business or commercial purposes only — not for personal, political campaigning, or unlawful activities.
- You must provide accurate registration information and keep your account details up to date.
- You must not be located in, or use the Service on behalf of anyone located in, a jurisdiction where use of the Service is prohibited.
3. Description of Service
WA Bulk Sender is a software-as-a-service platform built on the official WhatsApp Business API (Cloud API). Features include, without limitation:
- Bulk and scheduled WhatsApp template broadcasts to contact lists
- Recurring broadcast schedules (daily, weekly, monthly)
- Team inbox for inbound and outbound WhatsApp conversations
- Contact list management, CSV import/export, attributes, and timeline stages
- Datasets for broadcast personalisation
- Template creation, cloning, and sync with Meta
- Multi phone number support under one WhatsApp Business Account
- Team collaboration with Owner, Admin, and Agent roles
- Prepaid wallet billing with Razorpay recharge
We may modify, add, or remove features at any time. We do not guarantee uninterrupted availability or specific delivery or read rates for messages.
4. Account Registration and Security
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activity under your account, including actions by team members you invite.
- Notify us immediately at kritap@krishnaaman.in if you suspect unauthorised access.
- We may suspend or terminate accounts that violate these Terms or pose a security risk.
- One person or legal entity may not maintain more than one free-tier account for abusive purposes.
5. WhatsApp and Meta Compliance (Critical)
The Service depends on Meta's WhatsApp Business Platform. By using the Service, you agree to comply at all times with Meta's applicable policies, including:

- WhatsApp Messaging and Template rules — https://developers.facebook.com/docs/whatsapp/pricing
You specifically acknowledge and agree that:
- You may only message users who have opted in or with whom you have a permitted relationship under WhatsApp rules.
- Marketing and promotional messages outside the 24-hour customer service window must use Meta-approved message templates.
- Meta may approve, reject, pause, or disable templates and phone numbers at its sole discretion.
- Meta imposes messaging tier limits and quality ratings that affect how many unique users you can message per day.
- You are solely responsible for message content, template variables, and the legality of your contact lists.
- You must honour opt-out requests immediately. The platform supports STOP/START keywords and opt-out quick-reply buttons.
- You must not use the Service for industries or content prohibited under the WhatsApp Commerce Policy.
- Meta charges conversation fees separately from our platform wallet fees. Meta pricing is subject to change without notice.
We are not Meta or an official WhatsApp Business Solution Partner unless explicitly stated in writing. The Service is built on the WhatsApp Business API / Cloud API.
6. Acceptable Use
You must not use the Service to:
- Send spam, unsolicited bulk messages, or messages to contacts without valid consent
- Harass, threaten, defame, or discriminate against any person
- Promote illegal goods or services, counterfeit products, or restricted industries under WhatsApp policies
- Distribute malware, phishing content, or fraudulent schemes
- Promote multi-level marketing pyramid schemes, gambling where prohibited, or hate speech
- Impersonate another person or business
- Reverse engineer, scrape, or attempt to gain unauthorised access to the Service or third-party systems
- Resell or sublicense the Service without our written consent
- Circumvent messaging limits, opt-out mechanisms, or billing controls
7. Customer Content and Contact Lists
"Customer Content" includes contact lists, messages, templates, datasets, media, and any data you upload or transmit through the Service.
You retain ownership of your Customer Content. You grant us a limited, worldwide, non-exclusive licence to host, process, transmit, and display Customer Content solely to provide and improve the Service.
You represent and warrant that:
- You have all necessary rights and consents to upload and message your Contacts
- Your Customer Content does not violate any law, third-party rights, or WhatsApp policies
- Your use of personal data complies with the Digital Personal Data Protection Act, 2023 and other applicable Indian laws
8. Broadcasts, Templates, and Opt-Out
- Opted-out contacts are excluded from broadcast audiences automatically where configured.
- You are responsible for including opt-out mechanisms in marketing templates where required by law and WhatsApp policy.
- Scheduled and recurring broadcasts may be cancelled before execution where the platform provides that feature.
- Delivery, read, and failure statuses depend on Meta and recipient devices — we do not guarantee outcomes.
- Failed broadcast messages may be retried through platform features where available; retries may incur additional fees.
9. Team Accounts
- Owners and Admins can invite team members and assign roles (Owner, Admin, Agent).
- You are responsible for all actions taken by team members under your account.
- Agents may have restricted access to broadcasts, templates, and datasets as designed by the platform.
- You must remove team members who no longer require access.
10. Fees, Wallet, and Taxes
The Service uses a prepaid wallet model denominated in Indian Rupees (INR):
- You must recharge your wallet via Razorpay before platform message fees can be deducted.
- Recharge amounts are subject to minimum and maximum limits displayed in the billing section (currently ₹100 to ₹50,000 per transaction).
- Platform fees are debited from your wallet when messages are delivered, based on message category rates shown in the dashboard.
- Meta/WhatsApp conversation charges are billed separately by Meta and are your responsibility. We may display approximate Meta charge breakdowns for informational purposes only.
- Broadcasts and sends may be blocked if your wallet balance is insufficient.
- All fees are exclusive of applicable taxes (including GST, if applicable). You are responsible for any taxes associated with your use of the Service unless we are required by law to collect them.
11. Refunds and Chargebacks
- Wallet recharges are generally non-refundable once credited, except where required by applicable law or Razorpay policy.
- Unused wallet balance is not automatically refunded upon account closure.
- If you initiate a chargeback without valid reason, we may suspend your account pending investigation.
- Billing disputes must be raised within 7 days of the transaction by emailing kritap@krishnaaman.in.
12. Service Availability and Changes
We strive to maintain reliable service but provide the Service on an "as available" basis. Scheduled maintenance, third-party outages (including Meta or Supabase), force majeure events, or security incidents may cause interruptions. We may change pricing, features, or these Terms with notice where required by law. Continued use after changes constitutes acceptance.
13. Intellectual Property
The Service, including software, design, logos, documentation, and all related intellectual property, is owned by KrishnaAman Ventures or its licensors. These Terms grant you a limited, revocable, non-exclusive, non-transferable licence to use the Service for your internal business purposes. You may not copy, modify, distribute, or create derivative works of the Service except as expressly permitted.
14. Confidentiality
Each party agrees to protect the other's confidential information with reasonable care and use it only for purposes of the Service. Confidential information does not include information that is public, independently developed, or lawfully obtained from a third party without restriction.
15. Termination
- You may delete your account at any time via Settings. Account deletion initiates removal of your data subject to our Privacy Policy and legal retention requirements.
- We may suspend or terminate your access immediately if you breach these Terms, WhatsApp policies, or applicable law, or if required by Meta or legal authority.
- Upon termination, your licence to use the Service ends. Provisions that by nature should survive (including payment obligations, disclaimers, limitation of liability, and indemnification) will survive.
16. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that messages will be delivered, read, or free of errors; that the Service will be uninterrupted or error-free; or that Meta will approve your templates or maintain your WhatsApp account in good standing.
17. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEITHER KRISHNAAMAN VENTURES NOR ITS DIRECTORS, EMPLOYEES, OR SUPPLIERS SHALL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE IN ANY 12-MONTH PERIOD SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THAT 12-MONTH PERIOD, OR (B) INR 5,000.
Some jurisdictions do not allow certain limitations; in such cases, our liability is limited to the fullest extent permitted by law.
18. Indemnification
You agree to indemnify, defend, and hold harmless KrishnaAman Ventures, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:
- Your Customer Content or contact lists
- Your messages or campaigns sent through the Service
- Your violation of these Terms or WhatsApp/Meta policies
- Your violation of applicable law or third-party rights
- Actions of your team members under your account
19. Governing Law and Disputes
These Terms are governed by the laws of India. Subject to applicable law, the courts at Gwalior, Madhya Pradesh shall have exclusive jurisdiction over disputes arising from these Terms or the Service.
Before initiating formal proceedings, you agree to contact us at kritap@krishnaaman.in and attempt to resolve the dispute in good faith for at least 30 days.
20. Force Majeure
We are not liable for failure or delay due to events beyond our reasonable control, including natural disasters, war, government actions, internet or telecom failures, Meta/WhatsApp platform outages, or third-party hosting failures.
21. Miscellaneous
- Entire agreement — These Terms and the Privacy Policy constitute the entire agreement regarding the Service.
- Severability — If any provision is unenforceable, the remainder stays in effect.
- No waiver — Failure to enforce a provision is not a waiver of future enforcement.
- Assignment — You may not assign these Terms without our consent. We may assign them in connection with a business transfer.
- Notices — We may send notices to your registered email or through the Service.
